1. The Defendant’s KRW 51,839,816 as well as the Plaintiff’s annual rate of 5% from November 3, 2017 to June 23, 2020, and the following.
Reasons
1. Determination as to the cause of claim
A. 1) The Defendant is a stock company C (hereinafter “C”) on February 9, 2017.
B) The business of constructing multi-household housing on the ground outside D and four parcels owned by the Defendant (hereinafter referred to as the “instant business”).
(C) have entered into a joint implementation agreement with the following terms and conditions. Article II: (1) of the Development Period (C);
(2) Within 4 months after the commencement of the construction work, Eul shall complete the responsibility within 12 months after the commencement of the construction work. Within the construction period, Eul shall also complete the sale of land. Article 3 shall determine the land price as KRW 1,50,000 per square meter with the land price of KRW 1,513,50,000. Article 4 shall be 150,000 as the down payment out of the first payment to Gap. The payment method of land payment shall be 60,000,000,000 as the down payment within one month after the commencement of the construction work, the remainder 763,50,000,000 won shall be paid in cash after completion of the construction work. Article 7 (1) shall be a lump sum design work with the competent authorizing authority after the completion of the construction work, the construction work shall be selected from 00,000,0000, 2000, 2000, 300, 3000,000,00,00,0
3) On July 13, 2017, the Plaintiff: (a) held a general meeting of partners, and passed a resolution to transfer the equity shares of its members to E and C, one-half each, respectively; and (b) held the Plaintiff’s representative director. (c) On August 22, 2017, the Plaintiff and the Defendant held the Plaintiff’s office as the Plaintiff’s representative director. (d) On August 22, 2017, the Plaintiff and the Defendant read as “the name of construction: the construction of the collective housing in Seopo-si, Seopo-si, Seopo-si, and the construction cost: 6,129,176,00 won; and the construction period: from August 22, 2017 to April 30, 2018.
