피고인은 2019. 12. 16. 18:30경 창원시 마산회원구 B에 있는 C 마산점 엘리베이터에서, 라이터 모형의 초소형 캠코더를 손에 쥔 채로 피해자 D(여, 가명) 옆에 앉아 신발 끈을 묶는 척하면서 캠코더로 피해자자 몰래 피해자의 치마 안을 촬영한 것을 비롯하여 2019. 4.경부터 2019. 12. 16.경까지 별지 범죄일람표 기재와 같은 방법으로 총 54회에 걸쳐 캠코더와 휴대전화의 동영상 촬영 기능을 이용하여 피해자의 성적 수치심을 일으킬 수 있는 신체를 피해자의 의사에 반하여 촬영하였다.
