1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of the disposition;
A. The Plaintiff entered the Army on October 13, 2009 and was discharged from military service on August 7, 201, while serving in the Army.
B. On June 28, 2013, the Plaintiff filed an application with the Defendant for registration of persons who have rendered distinguished services to the State on the basis of the difference in application for the “galvine melting snow in the bilateral eye and pulmonary Tuberculosis” (hereinafter “instant wounds”).
C. On November 11, 2013, the Defendant, following the deliberation and resolution of the Board of Patriots and Veterans Entitlement, went through a private soldier living in barracks for 24 hours with respect to pulmonary tuberculosis among the instant wounds, and caused more than one year and two months after entering the military, and thus, constitutes a military person and police officer under the Act on Support for Persons Eligible for Veteran’s Compensation, which is recognized to have proximate causal relation with military duties. However, with respect to melting the eye, the Defendant determined that it does not meet the requirements for persons who have rendered distinguished services to the State and persons eligible for veteran’s compensation on the ground that there

2. Whether the instant disposition is lawful
A. The Plaintiff asserted that: (a) from the time of a new disease, the Plaintiff performed the work of operating various duties and computer equipment under the care of the underground control room in which the sunlight was cut off; and (b) during that process, pulmonary tuberculosis was generated; and (c) melting the snow melting in both banks also aggravated in the above poor environment.
Therefore, even though the Plaintiff’s performance of duties directly related to national security, etc. was caused by the occurrence of this case’s injury, the disposition of this case to be otherwise determined is unlawful.
B. In order to be recognized as a soldier or policeman on duty under Article 4(1)6 of the Act on the Honorable Treatment and Support of Persons, etc. of Distinguished Service to the State, which applies to the determination of the part concerning pulmonary tuberculosis among the instant injuries, the part concerning pulmonary tuberculosis among the instant injuries directly related to national defense, security, etc.
