Punishment of the crime

The Defendant sent a photograph of friendship and travel to the “Pestbook”, and the Defendant reported this fact to the “Pest North Korea” that C of this high school had the desire of the “Pestian” to the “Pest North Korea.”

1. Intimidation;

가. 피고인은 2014. 7. 14. 18:27경 안양시 동안구 D, 7A동 401호 피고인의 집에서 피해자가 위와 같은 욕설을 ‘페이스북’에 남겼다는 이유로 화가 나 피해자에게 “븅신ㅋ 꿀리는 게 없으면 뭐가 무서워서 페북친구도 다 끊고 뒤에서 씹고 있냐 ㅋ 뒤에서 지랄하지 말고 7시 반까지 범계역 킴스 앞으로 나와라. 안 오면 볼만한 상황이 펼쳐질 거야 기대해 ^^“ 라는 ‘페이스북’ 개인메시지와 휴대폰 문자메시지를 전송함으로써, 피해자가 약속 장소로 나오지 않으면 피해자가 동성애자인 사실을 그 가족 등에게 알릴 것 같은 태도를 보여 피해자를 협박하였다.

나. 피고인은 계속하여 같은 날 18:36경 피해자에게 “닥치고 니네 집 앞으로 와 ㅋ”, “E 어머니께 인사나 드려야지”라는 휴대폰 문자메시지를 전송함으로써, 피해자가 약속 장소로 나오지 않으면 피해자의 집을 찾아가 피해자의 어머니에게 피해자가 동성애자인 사실을 알릴 것 같은 태도를 보여 피해자를 협박하였다.

2.
