A defendant shall be punished by imprisonment for two years.

However, the execution of the above punishment shall be suspended for three years from the date of the final judgment.

Punishment of the crime

The Defendant is the representative director of the “C Agricultural Partnership” established for the purpose of agricultural products production support and operation distribution business.

Around August 209, the Defendant filed an application with the Korea Military Office for a subsidy program with respect to a project to build a foundation for the production of forest income in 2010 square meters with respect to a project to build a foundation for the production of forest income in the Korea Forest Service (hereinafter referred to as the “Uanan Military Office”) and to install a molecular production facility, a water cooling facility, a low temperature storage facility, etc. to manufacture and distribute products such as sulfur hetopy X-gu, Yan-Gun (5,030 square meters) by processing pots into D land (5,030 square meters) located in Nam-nam-do (hereinafter referred to as the “EM”) and to build a subsidy program with the exception of the total project cost of KRW 80 million (50 million), KRW 40 million (50%) and KRW 48 million (6%) and KRW 1200 million (14%).

On May 25, 2010, the Defendant: (a) obtained approval to change the place of business to install the said facilities in the Seoul-gun, Chungcheongnam-do; and (b) implemented a subsidy program, such as construction of a new office and processing facility (135 square meters on a first floor, 135 square meters on a second floor, 106.5 square meters on a low temperature storage warehouse (33 square meters); and (c) 1 square meters on a water cooling warehouse (36 square meters), from the said temporary date to March 24, 2011.

Although the Defendant did not have the ability to pay his own contributions, he had the intent to receive the said subsidies by submitting the details of payment of false contributions to the trading company using the fact that the management and supervision of the Muan Military, which is the supervisory authority for the Muan Military, applied for the subsidized project as above and submitted it to the Muan Military Administration.

Around June 25, 2010, the Defendant submitted a first claim for subsidies for the amount of 400 million won to the public official in charge in the forest environment of the State-owned Forest Department of the State-owned District of the State-owned District of the State-owned District of the State-owned District of the State-owned District of the State-owned District of the Republic of Korea, which is located in 530,000,000 won, and attached a written confirmation of bank transaction statement to the effect that he/she paid the amount of 50,000 won to G Co., Ltd. on April 30, 2010, and 22,000 won to H on June 22,
