A defendant shall be punished by imprisonment for not less than eight months.

Reasons
Punishment of the crime
around March 31, 2016, the Defendant up to 2906 posted a letter stating that he/she will open and sell smartphones from the Defendant’s house located in Goyang-gu, Goyang-si, Seoyang-si to NA (H). Notwithstanding the absence of intention or ability to sell smartphones, the Defendant enticed the victim I who reported and contacted such writing as if he/she sold smartphones to the Defendant as if he/she had sold the smartphones to the J bank account (K) in the name of J, from March 31, 2016 to May 31, 2016 to receive KRW 370,000 in the name of smartphones from the victim to May 31, 2016.
On March 26, 2016, the Defendant reported to the effect that the Defendant sold a portable phone on the Internet Round at an infinite place (hereinafter referred to as “2016 high group”) around 2016, and sent two phone calls to the Victim L who contacted with the Defendant, “on the face of the deposit of the mobile phone price in advance, I will deliver two phone calls.”

However, even if the defendant receives the payment of the telephone to be carried by the injured party, he was thought to use it for the purpose of living expenses, etc., and he did not have the intention or ability to deliver the telephone to the injured party.
As such, the Defendant, by deceiving the victim and receiving from the victim, KRW 1,130,00 from the victim’s bank account in the name of the J on the same day, and received KRW 4,130,00 in total from seven victims to June 13, 2016 in the same manner as indicated in the crime sight table (section 6) in the same manner.
