그럼에도 불구하고 피고인은 2016. 8. 중순경부터 2017. 1. 말경까지 사이에 경기 부천시 소사구 C, 2 층 8호에서 'D' 라는 상호로 휴대전화 판매업체를 운영하면서 ( 주) 제우스 네트 웍스와 인터넷 전화번호 E 등 200 회선을 계약하고, ( 주) 하프 콜의 오토 콜 프로그램에 가입하여 계약한 위 번호를 발신자로 하여 휴대전화 판매 광고 음성스팸을 불상의 휴대전화번호 사용자에게 전송하기 위하여, 엑셀프로그램을 이용하여 휴대전화번호를 자동으로 생성하고 생성된 전화번호로 광고 음성 스팸을 전송하여 957회에 걸쳐 위와 같이 엑셀프로그램으로 휴대전화번호를 자동으로 만들어 내는 조치를 하였다.
