A defendant shall be punished by imprisonment for three years.

However, the execution of the above punishment shall be suspended for four years from the date this judgment becomes final and conclusive.

Reasons

Punishment of the crime

From November 2013, the Defendant was in the process of threatening the victim C (the female, the 32 years of age), who was a woman, and the her husband, demanding the victim to clarify his/her family and her husband to be aware of his/her husband, thereby creating apprehensions.

1. Rape;

A. Accordingly, the defendant raped the victim four times in total.

2. A defendant who violates the Act on Special Cases concerning the Punishment, etc. of Sexual Crimes (amerasation and photographing) shall rape the victim and commit himself/herself at the time and place specified in paragraph (1).
