1. The Defendant shall pay to the Intervenor succeeding to the Plaintiff KRW 21,143,152 and KRW 20,794,248 among the Plaintiff’s Intervenor from August 21, 2014.
Reasons
1. Determination on the claims of the Plaintiff’s succeeding intervenor
(a)as shown in the reasons for the attachment of the claim;
(b) Judgment by service based on which recognition is applicable (Article 208 (3) 3 of the Civil Procedure Act);
2. As the Plaintiff transferred his claim against the Defendant to the Intervenor succeeding to the Plaintiff during the instant lawsuit pending, the Plaintiff’s claim is without merit.
(Plaintiffs filed an application for withdrawal on July 28, 2015, but their withdrawal has no effect without the Defendant’s consent).
