A defendant shall be punished by imprisonment for four months.

However, the execution of the above punishment shall be suspended for one year from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On March 2015, the Defendant committed the crime against North-gu B and C land at the port of port: (a) purchase of land from the actual owner E at port and the registration of ownership transfer in the name of the Defendant; (b) request F to maintain the existing registration of ownership transfer in the name of F and F in the name of the nominal owner of the said land; and (c) granted F permission.

Accordingly, the Defendant registered the real right to the above real estate in F name according to the title trust agreement with F.

2. 포항시 북구 B, C 지상 건물에 대한 범행 피고인은 2015. 11.경 불상지에서 포항시 북구 B, C 토지 위에 피고인이 건축한 G아파트 H호, I∼J호, K∼L호, M∼N호, O∼P호, Q∼R호, S∼T호, U∼V호, W∼X호, Y∼Z호, 총 28개의 건물에 대하여 보존등기를 함에 있어 F에게 그의 명의를 빌려줄 것을 요청하고 F은 이를 허락한 후 2015. 12. 1. 대구지방법원 포항지원 등기과에서 위 토지에 대하여 F 명의의 소유권보존등기를 경료하였다.

Accordingly, the Defendant registered the real right to the above real estate in F name according to the title trust agreement with F.

The reason behind sentencing under Article 62(1) of the Criminal Act, namely, the act of registering under the name of the title trustee pursuant to the title trust agreement, is a crime that undermines transparency in real estate transactions, and thus, it is necessary to strictly punish the instant crime.
