A defendant shall be punished by imprisonment for three years.

Punishment of the crime

From April 27, 2009 to May 14, 2012, the Defendant purchased computer IT-related products from manufacturers, etc. and supplied them to enterprises, and worked as business employees at the Daejeon Branch of the Victim C Co., Ltd (hereinafter “C”).

On 2010, the Defendant lost KRW 10 million at the market price supplied by the headquarters C in order to deliver the goods to the Customer, and instead did not report to the company, and deposited the price into the company. In order to deposit the price, the Defendant did not actually conclude a contract to sell the goods to the customer, submitted the written order by the customer to the head office by forging the written order by the customer, and did not sell the goods supplied by the headquarters to the customer, and sold and commercialized the goods at the market price on the electronic equipment market without selling the goods supplied by the headquarters to the customer, and did not pay to the company.

On October 14, 201, the Defendant: (a) at the Daejeon Daejeon Branch Office located in Seo-gu, Daejeon; (b) even though there was no fact that the Defendant intended to purchase the CPU, etc. at the E Co., Ltd. (hereinafter “E”), which is a business partner, to be supplied and commercialized with products from the headquarters as above, the Defendant: (c) instead of using a computer, by printing out an order form in the name of E representative director F that was previously received from the former E; and (d) revising the order form using a computer; (c) “C”; (d) “E”; (e) “1101,017”; and (e) “162,400; (e) unit price 262,00; (f) unit price 52,400; (f) volume 200,000; (f) volume 20,500,000,00D; and (f) quantity 80,00,00.

Accordingly, for the purpose of exercising authority, the Defendant, without authority, forged a letter of order, which is a private document on the rights and obligations in the name of E representative director F, and between around that time, to March 29, 2012, as described in the attached Form List (1) in the above manner, respectively, one copy of the order issued in the name of E representative director F.
