피고인은 2020. 5. 17. 21:38경 대전 동구 B에 있는 ‘C’ 부근 도로에서 피해자 D(여, 가명, 13세)이 혼자 걸어가는 것을 발견하고 피고인이 키우던 애완견을 안고 피해자를 뒤따라가 피해자에게 “연락처 좀 알려줘요. 예뻐서 그래요. 맥주 한 잔 먹을래요 ”라고 요구하였으나 피해자로부터 거절당하자 쭈그려 앉은 자세로 갑자기 손으로 피해자의 왼쪽 종아리 부위를 만지고, 계속하여 피해자를 따라다니면서 손으로 피해자의 손목을 잡아당겼다.
