1. 피고인들의 도박공간개설 피고인 A, 피고인 B, 피고인 C, 피고인 D은 H 등과 함께 2018. 4.경 서울 이하 불상지에서, ‘말레이시아 조호바루에 사무실을 차리고 인터넷 도박사이트 “I”를 개설하여 필리핀에서 운영되는 카지노 도박장의 실시간 동영상을 불상의 방법으로 전송받아 제공하고, 대포통장을 이용하여 도박사이트 회원들로부터 도박 자금을 입금받아 “알”이라는 게임머니를 환전해주며, 필리핀 카지노 도박장에서 진행되는 바카라, 블랙잭, 룰렛, 식보 등의 게임진행에 따라 도박사이트 회원들이 사이버머니 “알”을 게임 승패에 걸면 그 결과에 따라 사이버머니를 지급하고, 도박사이트 회원들의 요청이 있으면 그 사이버머니를 일정 수수료를 제외한 후 현금으로 환전하여 주는 방식‘으로 도박사이트를 운영하기로 모의하였다.
