The judgment below

In light of the records, the court below's measure of maintaining the judgment of the court of first instance which acquitted the defendant on the ground that the violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Death or Injury caused by Dangerous Driving) among the facts charged in this case constitutes a case where there is no proof of the crime. There is no violation of the law of logic and experience and the principle of free evaluation of evidence, nor violation of the legal principles as to the duty of a trial and the modification of indictment

Therefore, the appeal is dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
