A defendant shall be punished by imprisonment for three years.
However, the execution of the above punishment shall be suspended for five years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
The defendant is a teacher who teaches the subjects of Korean language in the D Middle School in Chungcheongnamcheon-gun, Chungcheongnam-gun, Chungcheongnam-gun, and the victims are students attending or graduated from the same school.
The defendant knew that the victims were ageed and could not actively resist their lives, and tried to commit an indecent act or abuse by using it.
1. The Defendant violated the Act on the Protection of Children and Juveniles against Sexual Abuse (Indecent Act by compulsion) committed an indecent act by force against the victims of children and juveniles over 33 occasions, such as the following Nos. 1 through 14, 16 through 22, 24, 26, 28 through 33, 35, 38, 40, and 45: (a) on March 2012, the first floor of the D Middle School No. 201, facing each other with the victims E (the age of 13) and met once; and (b) on April 17, 2014, and (c) around that time, the Defendant committed an indecent act by force against the victims of children and juveniles over 33 times.
2. On April 2012, the Defendant: (a) committed an indecent act by force against the victims under the age of 13 over 11 times, as indicated in the following No. 34, No. 36, 37, 39, No. 41 through 44, 47, 51, and 52, on the first floor of the D Middle School 1, the Defendant, who violated the Act on Special Cases Concerning the Punishment, etc. of Sexual Crimes (the minor indecent act under the age of 13), by walking opposite to the victim F (the age of 12) in the corridor of the first floor of the D Middle School 1; (b) attempted to interfere with the victim’s sexual organ part; and (c) forced the victims under the age of 13, as the victim’s sexual organ part was extended, from around that time to April 10, 2014.
3. The body of another person who may cause sexual humiliation or sense of shame by using a camera or other similar mechanism with a similar function.
