A shall be punished by a fine for negligence of KRW 3,000,000, and by a fine of KRW 5,000,000.

The above fine is imposed against the Defendants.

Punishment of the crime

[Presumption Facts] Defendant B is a person who actually operates Real Estate Development Business Co., Ltd. C (the wife D of Defendant B: Defendant F, outside director: Defendant B’s wife D) and Defendant E (the wife of Defendant B), and Defendant A was the representative director of Defendant B’s company G (hereinafter “G”) from November 6, 2013 to February 29, 2016.

B around May 2015, he purchased Sacheon City I and J (hereinafter “the instant project site”) from Defendant A under the name of G, which he lent the name of G from Defendant A, and tried to obtain profits from market price by filing an application for approval of the tourism source development project with the Sacheon City Mayor.

Accordingly, on July 1, 2015, Defendants entered into a sales contract to purchase the above business site in G name with KRW 950 million, and Defendant B applied for approval of a tourism agricultural source development project equivalent to KRW 2.7 billion in total construction cost in G name with respect to the above business site around July 7, 2015, and Defendant A transferred the ownership of the above business site to G around July 31, 2015, Defendant B paid KRW 520 million to the above H with loans from the said association, and Defendant B paid KRW 50 million with the remainder of the sales price.

After that, Defendant B entered into a sales contract with the K in charge of the above business division to sell KRW 1.35 million to the K in charge of the above business division without obtaining the approval on October 22, 2015, and Defendant B entered into the sales contract with the K in charge of the above business division ( approximately KRW 935 million,000,000,000,000,0000,0000,000,000,0000,000,0000,0000,0000,0000,0000,0000,0000,000,000,000,000,000).
