According to the examination, on March 30, 2001, the Defendant was issued a payment order decision against the Plaintiff by Suwon-si District Court 2001Guj688 (hereinafter “instant payment order order”) and the above decision became final and conclusive on April 15, 2001, it is obvious to this court. However, it is reasonable to view that the Defendant’s claim for the purchase price against the Plaintiff was extinguished on April 5, 201 when 10 years have elapsed since the date the above decision became final and conclusive.

Therefore, since the extinctive prescription of the claim for the purchase price regarding the payment order of this case has expired, compulsory execution based on the above payment order should not be allowed.
