Defendant shall be punished by a fine of one million won.
If the defendant does not pay the above fine, KRW 100,000.
Reasons
Punishment of the crime
The defendant, as the director of the B Secretariat, submitted a report on the result to the above Foundation, along with evidentiary documents on the details of the use of national subsidies after the completion of performance, when the above Incorporated Association received national subsidies from C from the National Treasury.
1. Alteration of private documents;
A. From August 23, 2011 to September 9, 2011, the Defendant: (a) prepared a report on the result of “G regular performances” conducted on August 6, 2011; and (b) changed the date of issuance of the remittance receipt that was paid to the contributor in the performance conducted on June 2011; (c) changed the date of issuance of the remittance receipt into the document that was paid the contribution fee on August 6, 201; and (d) changed the date of issuance of the said receipt to the document that was issued on June 23, 2011, stating that the Defendant transferred KRW 200,000 to the H account; and (d) changed the date of issuance of the said receipt by copying the document that was “201/08/23” on the date of issuance of the J receipt under the name of branch employees of the I Bank, as well as the document printed out on August 23, 2011.
Accordingly, the Defendant changed the remittance receipt in the J's name, which is a private document on proof of facts for the purpose of exercising the right.
B. On November 25, 2011 to December 12, 2011, the Defendant prepared a report on the results of “K” implemented on November 25, 201, and “K” as of November 25, 2011, the Defendant is deemed to have changed the date of issuing a remittance receipt that was paid a contribution to the contributor at a performance conducted on June 2011 and submitted a document to submit the document of proving that he/she paid a contribution fee to the donor on November 25, 201, and remitted KRW 200,000 to H account. The Defendant is deemed to have “the date of issuing a remittance receipt under the name of J branch employees of I Bank Young-dong branch employees” on June 23, 2011.
