Punishment of the crime

1. Crimes against Victims A Q;

A. On October 20, 2016, the Defendant posted a false advertisement to the effect that “the Defendant shall sell bags, such as accelerators, to which he/she is holding,” by accessing the NAS PC from “AS PC room located in the north-gu, Chungcheongnam-gu, Chungcheongnam-gu, Chungcheongnam-gu, and that “the Defendant will send two above AS PCs to the Defendant, if he/she first send the price.”

However, in fact, the Defendant did not possess the banks ordered by the victim at the time, and the supply source was not secured, so even if he received the price from the victim, he did not have the intention or ability to send the bags as agreed.

Nevertheless, the defendant deceivings the victim as above, and 270,000 won was transferred to the post office account in the name of J (T) designated by the defendant for the same day from the victim.

B. On April 28, 2017, the Defendant was the president of the Red Congo who carried on the business of leaving a horse by calls from the victim at the place described in the foregoing paragraph (a) on April 28, 2017.

If a person makes an investment in the Party, he/she may receive KRW 100,000 per old unit (three million won per day), KRW 200,000 per two old units (five million won per five million), and KRW 400,000 per four old units (one million per four previous units) as a daily dividend.

However, in fact, the above contents related to the investment in the red bean were all made by the defendant, and even if the defendant received money from the injured party, the defendant was merely willing to consume money under his personal name, such as making virtual currency investments, and did not have the intent to make an investment or to pay dividends as agreed with the injured party.

Nevertheless, the defendant is guilty.
