Defendant shall be punished by a fine of KRW 5,000,000.

When the defendant does not pay the above fine, 100,000 won.

Punishment of the crime

Around February 10, 2019, the Defendant: (a) received a proposal from a name-free person who misrepresented the employee of a lending company to the effect that “to obtain a loan by entering and withdrawing money from an account to increase credit rating; (b) he/she shall withdraw such money and deliver it to our employee; (c) he/she was aware that the Defendant, while running his/her business, obtained a loan over several occasions from the financial right 1 and 2; (d) was able to obtain a loan; and (e) was able to use his/her account in crimes, such as scaming, etc.; (e) the other party attempted to withdraw the loan through the Defendant with the concealment of accurate personal information; (e) instructed the other party to withdraw the loan in real time with the transfer of the place; (e) instructed the bank employee to do a crime, such as scaming, etc.; (e) provided the above name-free person with the account number deposited in the said account; and (e) provided the withdrawal to the account during the period of damage to the account.

On February 28, 2019, when a person whose account number has been received from the defendant, he/she made a false statement that "a loan may be made at low interest rate. It is possible to lend an existing loan to the victim at a low interest rate. It is possible to deposit the base loan repayment in the account notified by us." On the same day, he/she was remitted from the victim to the above B account in the name of the defendant at around 10:43 of the same day, and the defendant was remitted from the victim to the above B account in the name of the defendant at around 13:48 of the same day, and the defendant withdrawn KRW 50 million, which was remitted by the above victim at the head office of the F Association located in Yongsan-gu, Changwon-si, Changwon-si, Changwon-si, Seoul, and sent to the employee who was named in the vicinity of the above bank.
