Punishment of the crime

Around April 201, the Defendant stated that “A victim C’s house located in Gangseo-gu Seoul Metropolitan Government would need money to carry out a house funeral” to the victim’s house in Gangseo-gu, Seoul, and that “The principal will be repaid by making two registration certificates as security and payment of interest.”

However, one of the certificates of completion of the above registration that the Defendant entrusted as security is related to the real estate set forth in D branch E of the Nam-gu Incheon Metropolitan City, and the Defendant purchased the above real estate, and the Defendant was in the state of establishing the right to collateral with the debtor G and maximum debt amount of KRW 43 million to the FF Cooperative on March 15, 2011, and thus, the above real estate was rarely in value to collateral. The Defendant did not have any property under his/her name at the time, and even if he/she received money from the victim with no particular income nor with the debt exceeding KRW 200,000,00

Nevertheless, the Defendant: (a) deceiving the victim as above and received KRW 20 million from the victim’s husband H on May 4, 201; and (b) from the same day to April 17, 2012 from the same day, as shown in the list of crimes in the attached Table from April 17, 2012, the Defendant stated the amount of KRW 17,770,000 as KRW 25,000 per year in the list of crimes to be attached to the indictment from the victim; (c) however, since the amount actually transferred to H account is confirmed to be KRW 22,00,00,000, the amount of damage was corrected to KRW 22,00,00,000, and accordingly, the sum was revised to KRW 177,770,000.

Accordingly, the defendant was given property by deceiving the victim.
