B. The Defendant’s decision not to recognize refugee status (hereinafter “instant disposition”) - Grounds for not recognition of refugee status (see, e.g., November 13, 2015: hereinafter “instant disposition”): No well-founded fear of fear may be recognized.

The Plaintiff filed an objection with the Minister of Justice on November 19, 2015; however, the Plaintiff’s dismissal on March 23, 2016 [based on recognition] does not dispute; the Plaintiff’s entries in the evidence B Nos. 1 through 4 (including branch numbers), and the purport of the entire pleadings.

2. Whether the instant disposition is lawful

A. The Plaintiff’s assertion was engaged in supporting activities of Pakistan T-e-investmentsaf (hereinafter “PTPP”), which is a party of Pakistan. However, on September 2012, the Plaintiff entered the Republic of Korea as a result of assault and threat from the applicants of “Pakistan Musistan-Nwaz” (hereinafter “PMLN”), a party having found a regional political party office, who was a other party’s office around September 2012.

Since the Plaintiff’s return to Pakistan is likely to be stuffed by the support entity of the PMFN, the instant disposition that rejected the Plaintiff’s application for refugee status is unlawful.

(b) The definitions of terms used in this Act under relevant Acts and subordinate statutes shall be as follows:

The term "refugee" means a foreigner who is unable or does not want to be protected from the country of his/her nationality due to well-founded fear that he/she may be injured on the grounds of race, religion, nationality, status as a member of a specific social group, or political opinion, or a stateless foreigner who, owing to such fear, is unable or does not want to return to the country in which he/she resided before entering the Republic of Korea (hereinafter referred to as "state of his/her nationality");
