Defendant shall be punished by a fine of KRW 7,000,000.

When the defendant does not pay the above fine, 100,000 won.

[Criminal Power] On April 20, 2017, the Defendant was ordered to suspend indictment for a violation of the Road Traffic Act at the Ulsan District Prosecutors' Office.

【Criminal Facts】

On February 28, 2020, at around 02:45, the Defendant driven an EK7 vehicle under the influence of alcohol content of about 0.106% from the road front of the “C” week located in Yangsan-si B to the front road of D apartment in the same city.

Accordingly, the defendant violated Article 44 (1) or (2) of the Road Traffic Act not less than twice.

1. Articles 53 and 55 (1) 6 of the Criminal Act for discretionary mitigation;

The reason for the sentencing under Articles 70(1) and 69(2) of the Criminal Act (the statutory penalty: imprisonment with prison labor for not less than two years but not more than five years, or a fine of not less than ten million won and not more than 20 million won) of the Criminal Act; however, although the defendant was subject to the disposition of suspension of indictment for the crime of drinking driving, he/she is led to the confession of the crime of this case, and his/her mistake has been divided, and there is no other history of the punishment, and other factors of the punishment have been taken into account, such as the defendant's age, environment, blood alcohol concentration and driving distance, and conditions after the crime, etc., the punishment shall be determined as per the order.
