1. The Defendant’s KRW 306,678,466 within the limit of KRW 360,00,000 and KRW 75,00,00 among the Plaintiff and the Plaintiff’s KRW 76,00.
Reasons
1. Indication of claims: It shall be as shown in attached Form; and
2. Judgment by service (Article 208 (3) 3 of the Civil Procedure Act).
3. As the provisions governing statutory interest rates under the main sentence of Article 3(1) of the Act on Special Cases concerning the Promotion, etc. of Partial Dismissal Lawsuit were amended and promulgated on May 21, 2019 and enforced on June 1, 2019, only the interest rate of 15% per annum from March 16, 2017 to May 31, 2019 and the interest rate of 12% per annum from the following day to the date of full payment, shall be recognized, and the portion in excess shall be dismissed.
