A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
1. On March 2016, from around February 2018 to around February 2018, the Defendant: (a) had the victims who intend to purchase a vehicle in cash in order to pay back their debt and raise money for gambling due to gambling such as bonds, etc. due to gambling, and (b) had the victims who want to purchase a vehicle in cash from the victims who want to purchase a vehicle in 36-month installments; (c) had them purchase a vehicle in installments by soliciting the victims who want to purchase the vehicle in 36-month installments; and (d) have to pay the repayment fee in advance; and (e) had them purchase the vehicle in installments; and (e) had them receive the principal of the repayment installment from the victims.
On August 21, 2017, the Defendant: (a) purchased a vehicle at a 36-month rate at the Defendant’s recommendation, and subsequently made a false statement to the victim H (e.g., 29 years old) who wants to repay even during the purchase of the vehicle at a 36-month rate; and (b) “I would immediately transfer the repayment amount to the company of the capital capital and pay it to the company of the capital capital in the face of the State.”
However, even if the defendant receives the repayment from the injured party, he did not have the intention or ability to pay the individual debt and repay the installment loan to the injured party for the sports earth and sand.
As above, the Defendant, by deceiving the victim as above, received KRW 14,623,779 from the victim's bank account in the name of the Defendant on the same day from the victim, and acquired the remaining installment payments of KRW 14,623,779 from the victim, and acquired them through deception. From then on January 11, 2018, the Defendant acquired KRW 56,605,084 in total four times, such as the first installment of the annexed crime list 1.
2. A person who violates the National Sports Promotion Act (gambling, etc.) shall issue the right to vote for sports promotion or things similar thereto (including the issuance thereof through an information and communications network) and offer goods or property benefits to a person who has correctly predicted the result, who is not a national sports promotion corporation or an entrusted business operator;
