Reasons
Punishment of the crime
Defendant
A is a person who provides Internet computer game facilities without trade name on Daejeon Jung-gu C and the first floor, and the defendant B is an employee of the above game site.
1. No defendant A game products related business entity shall allow others to gamble or perform other speculative acts using game products, or leave the game products to do so, and no one shall provide the game products that have not been classified for the distribution or use thereof, or display or store them for such purposes;
Nevertheless, from around 17:00 on October 24, 2019 to 19:00 on the same day, the Defendant received KRW 300,000 from D, which had been equipped with 14 computers in the above game site, and paid the game money equivalent to KRW 300,00,00 which can be connected to the Internet E (F) website through E’s management page, and made D play the said game money through the above Ad, and allowed D to exchange it through its head office, after doing so.
Around October 24, 2019, the Defendant provided multiple customers, such as D, with game products using game products, or provided game products not classified.
2. Defendant B: (a) around October 24, 2019, from around 17:00 to around 19:00 of the same day, worked as an employee in a game without a trade name operated by A; (b) provided the game money to customers D, etc. who found the said game site with a charge, and provided information on the game method, thereby facilitating A to provide speculative businesses and unclassified game products for distribution or use.
Summary of Evidence
1. Whether the Defendants’ interrogation protocol of the police officer’s interrogation protocol concerning G in relation to the Defendants’ legal statements H, I, J, and D’s seizure protocol, internal investigation report on the seizure list (control and seizure process), and speculative game products are speculative game products.
