A defendant shall be punished by imprisonment for not less than eight months.

However, the execution of the above sentence shall be suspended for a period of two years from the date this judgment became final and conclusive.

Punishment of the crime

Except as otherwise expressly provided for in other Acts, no person shall keep, deliver or distribute any access medium with the knowledge that it is intended to use it for a crime, or store, deliver or distribute the access medium with the knowledge that it is intended to use it for a crime, except as otherwise provided for in other Acts.

그럼에도 피고인은 2016. 12. 말경 체크카드 모집 책인 성명 불상자( 위 챗 대화명 ‘D’) 의 지시에 따라 그가 지정해 주는 사람으로부터 체크카드 등 접근 매체를 교부 받아 이를 보관ㆍ전달하는 대가로 건 당 5만 원을 받기로 약속한 후, 2017. 1. 3. 경 경기 수원시 E에 있는 F 호텔 앞 노상에서, 접근 매체인 G 명의의 신한 은행 체크카드 1 장을 위 G으로부터 교부 받은 후, 위 체크카드가 범죄에 이용될 것을 알면서도 이를 위 성명 불상 자가 지정하는 물품보관함에 넣어 찾아가게 하는 방법으로 전달해 준 것을 비롯하여 그 때부터 2017. 1. 12. 경까지 사이에 별지 범죄 일람표 기재와 같이 총 21회에 걸쳐 총 21명으로부터 그들 명의의 체크카드 총 26 장을 교부 받아 이를 보관 또는 전달하고, 그 대가로 약 210만 원을 받았다.
