A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On April 23, 2016, the Defendant, in the “D Real Estate” located in Chungcheongnam-gun, Chungcheongnam-gun, Chungcheongnam-gun, would make a false statement to the victim E that the victim “is the owner of F in the Chungcheongnam-gun, intending to lease,” and on April 28, 2016, the victim “the actual owner is the owner, and the nominal owner is the G, the nominal owner of which is omitted. The reason why the name is different is that the name is divided into property and thus, the name is returned in the future.

After concluding the contract, G's proxy and certificate of seal impression will be given and the right to lease on a deposit basis will be granted.

The phrase “ makes a false statement.”

However, in fact, since the owner of the above building G, the defendant did not have the authority to conclude a lease contract for the above building even if he received the lease deposit from the damaged party.

As above, the Defendant: (a) deceiving the victim as above; (b) received KRW 1 million from the victim under the name of the Defendant on April 23, 2016 as the deposit money; (c) KRW 1 million on the 28th of the same month as the H; (d) KRW 3 million on the 28th of the same month as the Defendant’s name; (b) on May 17, 2016, KRW 1 million as the Defendant’s name; (c) on the 24th of the same month, as the I account under the name of the Defendant; (d) deposited KRW 2 million on June 18, 2016 as the Defendant’s name; and (e) received KRW 5 million directly on July 11, 2016 as the J account; and (e) acquired KRW 100,000 in total from the Defendant’s name on August 23, 2016 as the deposit money.

2. On May 2016, the Defendant forged a private document by using a computer at the place of influence on May 2016

1.The F Housing of Chungcheongnam-do, the name A, resident registration number K, the name of the authorized person L L, the address Chungcheongnam-do, and the above person shall delegate all the acts concerning the lease of the said real estate to the person as follows:

The amount of money for lease on a deposit basis: "The amount of money for lease on a deposit basis: from April 28, 2016 to two years, from April 28, 2016, from the name G, resident registration number M, address Cheongnam-do, F, and one copy of a certificate of seal imprint attached thereto," followed by G name.
