1. The plaintiff's claim is dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. On May 5, 2017, around 23:15, on the ground that the Plaintiff driven a Class 1 ordinary vehicle (license number: C) of the Plaintiff’s first-class ordinary vehicle (license number) as of June 17, 2017 by applying Article 93(1)1 of the Road Traffic Act, on the ground that the Plaintiff was under the influence of alcohol by 0.12% (the result of a smoking measurement) with a blood alcohol concentration of 0.12% (the result of a smoking measurement) on the roads in front of the subdivision of the subdivision of the party branch of Seonam-gu, Seonam-gu, Seonam-gu.
[Ground of recognition] No dispute, entry in Eul 4 to 8, the purport of the whole pleadings
2. Whether the instant disposition is lawful
A. The Plaintiff’s assertion completed a meeting, including a fluor and alcohol, on the day, and subsequently, the Plaintiff was driving a motor vehicle to drive a motor vehicle for about four hours in the vehicle, and was under the phone of his/her wife while driving a motor vehicle to return home rapidly.
In addition to these circumstances of drunk driving, the Plaintiff did not engage in a drunk driving or minor violation of the law for about 12 years, the Plaintiff’s speech and walking condition at the time of detection, the fact that the Plaintiff is in need of driving in order to provide technical support, etc. for the operation of construction equipment, and to visit a mother-child hospital with labor exchange, and the mother-child and spouse are obliged to support and bear a considerable amount of obligation. In light of the fact that the instant disposition is too harsh to the Plaintiff, thereby abusing or abusing discretion.
B. Even if the revocation of a driver's license on the ground of drinking driving is an administrative agency's discretionary act, in light of today's mass means of transportation and the situation where a driver's license is issued in large quantities, the increase of traffic accidents caused by drinking driving, the suspicion of its consequences, etc., the need for public interest to prevent traffic accidents caused by drinking driving should be emphasized, and the revocation of a driver's license on the ground of drinking driving is revoked.
