A defendant shall be punished by imprisonment for not less than one year and six months.
However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime
1. Around 08:00 on June 4, 2016, the Defendant driven B K5 cars without obtaining a driver’s license on the road in front of the middle-speed road of the Jinnam-gu, Seongbuk-gu, Sungnam-gu, Sungnam-gu, Sungnam-do.
2. Violation of the Act on the Aggravated Punishment, etc. of Specific Crimes (Aggravated Punishment, etc. of Specific Crimes), Violation of the Road Traffic Act (Measures Taken after Accidents), and the Defendant of the Road Traffic Act, at the dates and places specified in paragraph 1, have changed the course to three-lanes in front of the mid-gu tunnel in the direction of Gwangju at a speed of about 70 km from the direction of Gwangju to the direction of Sungnam.
In such cases, the driver of a motor vehicle has a duty of care to safely change the course after examining whether there is a vehicle in the way that he/she intends to change the front section and the left and right of the motor vehicle.
Nevertheless, the Defendant neglected this, while driving a D bargaining car driven by the victim C(24 years old) on the three-lanes, and due to the Defendant’s change of course, damages the victim’s back 114,808 won to the left-hand part of the above K5-laneed vehicle of the victim C by shocking the back-hand part of the above K5-laneed vehicle, and at the same time, damages the victim C’s wing vehicle with light c’s repair cost in need of approximately two weeks of medical treatment, and does not stop to the victim C and runs away without taking necessary measures, such as providing relief to the victim. As such, the Defendant does not immediately stop the vehicle at the scene of the accident, and then stop to the victim E (28 years old) with the front-hand part of the F wheel vehicle driven by the victim E (28 years old) who had been driving at the end of the said 3 km vehicle, and does not immediately cause any injury to the victim E, such as emergency rescue.
