A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.

1. 피해자 B(가명)에 대한 범행 피고인은 2019. 9. 11. 08:34경 안산시 단원구 C 아파트 내 보행자출입구 계단에서, 교복 치마를 입고 계단을 오르는 피해자 B(가명)을 발견하고 뒤에 가까이 붙어 따라가며 피고인 소유의 휴대전화(iPhone X)로 피해자의 치마 속을 비추었으나 ‘찰칵’ 하는 촬영음 때문에 들킬 것이 두려워 카메라 실행 버튼을 누르지 못하였다.

As a result, the Defendant tried to photograph the body of a person who may cause sexual humiliation or shame by using a camera or other similar mechanism, but did not commit it but intended to do so.

2. 피해자 D(가명)에 대한 범행 피고인은 2019. 9. 11. 08:36경 안산시 단원구 C 아파트 E동 놀이터 앞 계단에서, 교복 치마를 입고 계단을 오르는 피해자 D(가명)을 발견하고 뒤에 가까이 붙어 따라가며 피고인 소유의 휴대전화(iPhone X)로 피해자의 치마 속을 비추었으나 ‘찰칵’ 하는 촬영음 때문에 들킬 것이 두려워 카메라 실행 버튼을 누르지 못하였다.
