Defendant shall be punished by a fine of four million won.

If the defendant does not pay the above fine, KRW 100,000.

Punishment of the crime

The Defendant is the representative of the Seocho-gu Seoul Metropolitan Government “C” and is an employer who runs a service business, such as automobile management, using two regular workers.

1. An employer who violates the Minimum Wage Act shall pay workers subject to the minimum wage to pay wages exceeding the minimum wage amount. 5,210 won per hour from January 1, 2014 to December 31, 2014; 5,580 won per hour from January 1, 2015 to December 31, 2015; 6,030 won per hour from January 1, 2016 to December 31, 2016 to December 31, 2016; 6,470 won per hour from January 1, 2017 to December 31, 2017; and 7,530 won per hour from January 1, 2018 to December 31, 2018 to December 31, 2018.

Nevertheless, the Defendant, at the above workplace, has served from June 12, 2009 to June 25, 2018:

(a) When applying the hourly minimum wage in 2014, KRW 1,088,890 shall be paid each month, as it falls short of the hourly minimum wage, KRW 600,000 per the following month from April to December 2014;

B. In applying the hourly minimum wage in 2015, KRW 1,166,220 each month, even if the hourly minimum wage is paid, thus falling short of the hourly minimum wage, KRW 60,000 per month following January through December 2015;

(c) For the purpose of applying the hourly minimum wage in 2016, KRW 1,260,270 shall be paid each month, and 60,000 won shall be paid for the following month from January 2, 2016 to August 2016; and 6,50,000 won shall be paid for the following month from September 2016 to December 2016, respectively.

(d) In applying the hourly minimum wage in 2017, KRW 1,352,230 per month from January 2017 to June 2017, and KRW 1,572,210 per month from July 2017 to December 2017, as it is insufficient to pay KRW 1,572,210 per month, and KRW 650,00 per month from January 2017 to May 2017; KRW 1.3 million from June 2017; and KRW 1.5 million from July 2017 to December 2017;

E. When applying the hourly minimum wage in 2018, the hourly wage is paid in KRW 1,829,790 each month, but it falls short of such payment, and thus, 1.5 million won per the following month from January 2018 to May 2018; and
