피고인은 2020. 12. 5. 07:05 경 포항시 남구 B 앞에서 자신의 C 토스카 승용차에서 잠이 들면서 얼굴과 가슴 부위가 핸들에 있는 경적 버튼을 누르게 되어 계속 경적이 울렸고, 이에 ‘ 누가 자동차 클락션을 계속 울리고 있다’ 는 내용의 112 신고를 받고 출동한 포항 남부 경찰서 D 지구대 소속 경위 E에게 서 귀가할 것을 요청 받자 갑자기 위 경위 E에게 ‘ 씨 발 놈 니가 뭔 데 개새끼야’ 등의 욕설을 하고 머리와 발로 경적을 울려 위 경위 E이 이를 만류하자, 또다시 위 경위 E에게 ‘ 야 개새끼야, 내가 누 군지 아나, 씨 발 개새끼야’ 등의 욕설을 하며 손으로 위 경위 E의 멱살 부위를 잡아 수회 흔들고, 발로 위 경위 E의 배 부위를 수회 차고, 함께 출동한 경장 F가 이를 제지하자 손으로 위 경장 F의 멱살을 잡아 흔들고, 발로 위 경장 F의 배 부위를 1회 찼다.
