Punishment of the crime

Any person who intends to divert a mountainous district shall obtain permission from the head of the relevant forest office, etc. according to the classification of the types, areas, etc. of the mountainous district specifying its use.

Nevertheless, on April 201, the Defendant, without obtaining permission from the head of a forest office, etc., in the Pyeongtaek-gun, the head of a forest office, etc., destroyed the area equivalent to 72 square meters of a forest, such as piling away from the Defendant’s swine cattle shed in the vicinity, thereby converting the area into mountainous district so that the amount equivalent to 312,00 won of the restoration cost would be equivalent to the restoration cost.
