A defendant shall be punished by imprisonment for six months.

However, the execution of the above punishment shall be suspended for a period of two years from the date this judgment becomes final and conclusive.

Punishment of the crime

1. On February 11, 2015, the Defendant violated the Act on the Regulation of Similar Receiving Act: (a) established a D Association with its principal office as the head office of Gangnam-gu Seoul Special Metropolitan City C and 601; (b) brought about funds by means of investing money in the name of capital by inducing older persons who are aged in lack of social experience, even though they did not have obtained authorization, permission, registration, or report as prescribed by the Act and subordinate statutes in relation to the business of raising funds from many and unspecified persons; and (c) did not intend to raise funds by purchasing household goods, food, etc. at low cost, etc.; and (d) by selling them and distributing profits to them.

The defendant, around October 30, 2015, intends to guarantee the principal and to pay interest at 2% per month to the F who was found in the D Association office located in Seongbuk-gu Seoul Metropolitan Government E after being introduced.

“The F shall be recommended to provide the F with KRW 200,000 as an investment.”

In addition, on October 30, 2015, the Defendant agreed to pay the total amount of investment for business or the amount in excess thereof without obtaining authorization or permission, making registration or report, etc. under the statutes from around November 11, 2016, and received a total of KRW 30,160,000 from F on 12 occasions as stated in the attached Table (crime List).

2. Fraud;

A. The Defendant’s contribution fraud is a small amount of money that: (a) a person who establishes a D Association and operates as if he would raise a high rate of profit; (b) a total amount of money invested by the said Association did not have any property with a high rate of KRW 2.7 million; and (c) a person who entices the elderly by offering gift and gift gift, and sells medical appliances, health functional foods, etc.
