Transfer Registration of Ownership
Summary
If the original purchaser's purchase area has been divided differently from the original purchaser's purchase area as a result of the survey by the limit of occupation and use after the property devolving upon one parcel purchased by several occupants, the scope of ownership shall be the original purchase area regardless of the boundary in the public cadastral book.

1. On March 31, 1956, the Defendant shall implement the procedure for the registration of ownership transfer on the ground of sale on March 31, 1956 with respect to the Plaintiff’s share of 00,000 - 00 - 00 - 1,000 - 507 m2.
2. The costs of the lawsuit are assessed against the defendant.
Reasons
1. Facts of recognition;
A. Before the division, 00 00 - 00 - 00 - 00 - 100 - 00 - 114 m2 (hereinafter “instant land”) were owned by the Defendant as property devolving upon ownership. The Defendant sold 61m2 (200 m2) to the Plaintiff’s father-net Kim ○ and Kim ○, which possessed the instant land on March 31, 1956, and 453m2 (137m2) to the Defendant. Some of the land purchased by Kim ○ was donated to the Defendant as a road site, and the instant land was divided into 00-1,00 00 - 1,064m2, 00-2, 26m26m2, 300-3, 400-4m2 and 40-4m2.
나. 그 후 김○○이 사망하자 원고가 김○○의 재산을 상속하여 이 사건 토지 중 김○○이 피고로부터 매수한 부분을 점유하였고, 조□□의 조카인 조▣▣도 조□□이 피고로부터 매수한 부분을 양수하여 점유하였는데, 원고와 조▣▣는 1999. 10.경 위 매수부분에 관하여 소유권이전등기를 하기 위하여 피고에게 소유권이전등기를 신청하였으나, 측량과정에서 조▣▣가 당초 매수한 부분을 초과한 507㎡ 위에 건물을 건축한 사실이 드러나자, 원고는 우선 김○○이 피고로부터 매수한 이 사건 토지 중 557㎡에 관해서만 00시 00구 00동 1가 000-5 대 557㎡로 분필등기를 마친 후 2000. 6. 8. ○○지방법원 접수 제29011호로 1956. 3. 31. 매매를 원인으로 하여 자신의 이름으로 소유권이전등기를 마쳤고, 조▣▣는 이 사건 토지 중 나머지인 00시 00구 00동 1가 000-1 대 507㎡ 중 조□□이 당초 매수한 면적에 해당하는 453/507 지분에 관하여 2000. 6. 7. ○○지방법원 접수 제28783호로 1956. 3. 31. 매매를 원인으로 하여 지분소유권이전등기를 마쳐 이 사건 토지 중 나머지인 54/507 지분에 관하여는 피고 이름으로 소유권이전등기가 남아 있다.

2. Determination
According to the above facts, the Defendant is obligated to implement the registration procedure for transfer of ownership on March 31, 1956 with respect to the portion of 54/507 shares in the instant land, which falls under the remaining portion of the land that the Plaintiff had not been transferred from the Defendant, among the instant land purchased from the Defendant, as the inheritor of Kim○○, who purchased 661 square meters of the instant land prior to subdivision
3. Conclusion
Therefore, the plaintiff's claim is justified and accepted.
