A defendant shall be punished by imprisonment with prison labor for four months.
However, the execution of the above punishment shall be suspended for two years from the date this judgment becomes final and conclusive.
Reasons
Punishment of the crime

1. On March 28, 2018, the Defendant read at the CPC bank located in Pyeongtaek-si B, read the phrase “to purchase a computer RAM card” posted by the victim E on the D website, and made a false statement to the effect that “to send a computer RAM card if the price of the goods is deposited.”
However, the defendant did not have a computer management card to sell to the victim, and even if he received the price of goods from the victim, he did not have the intention or ability to send the goods.
The Defendant, by deceiving the victim as above, received 50,000 won from the victim’s company bank account (F) in the name of the Defendant on the same day as the price for the goods, and received totaling KRW 1,244,000 from around that time to May 18, 2018, as shown in the attached list of crimes, from around 41 times.
Accordingly, the defendant was provided property by deceiving the victims.

2. On October 18, 2018, the Defendant made a false statement to the effect that “The Defendant sells GTX760 Stel H,” and “The GTX760 EM,” the Defendant sent to the victim I who reported and contacted posted a notice registered on the Internet DF bulletin board, stating that “on deposit of KRW 37,000, the Defendant would deliver the goods to his domicile.”
However, in fact, the Defendant did not have the traffic card actually, and even if receiving money from the victim, there was no idea to seek it, so there was no intention or ability to send the traffic card as promised to the victim.
Around 22:41 on the same day, the Defendant received 37,000 won from the above victim to the corporate bank account (F) in the name of the Defendant and acquired it by fraud.

3. On October 26, 2018, the Defendant did not possess any content game CDs, not with the building J and K, from the Government of Jung-si on October 26, 2018. The Defendant connects Lcarpet D with no intent or ability to sell.
