Reasons
Punishment of the crime
A person who intends to convert a mountainous district shall obtain permission from the Administrator of the Korea Forest Service, etc. according to classification of mountainous districts specified by Presidential Decree, size, etc.
1. Joint criminal conduct by Defendant A and Defendant B
A. From June 2016 to August 2016, the Defendants conspired to commit a violation of the Management of Mountainous Districts Act on five parcels of forest land, including C, to remove miscellaneous trees, which were growing in the above forest by using scrows, from around June 2016 to around August 2016, the Defendant: (a) 3,570 square meters of forest land; (b) 3,326 square meters of forest land; (c) 1,345 square meters of forest land; and (d) 6,760 square meters of forest land, which is owned by Jeju Special Self-Governing Province; (b) 1,760 square meters of forest land; and (c) 1,760 square meters of forest land; and (d) 2, Defendant B, an engineerJ, using scrakes, ordered the removal of miscellaneous trees that were growing in the above forest land; (d) 3,508 square meters of forest land in total, with low gradient removal; and (e) 1, 9585 square meters of forest land within jurisdiction.
B. From January 2017 to February 2, 2017, Defendants in collusion to commit a violation of the Management of Mountainous Districts Act on five parcels of forest land including K, etc., the Defendant instructed the removal of miscellaneous trees, the adjustment of ground, etc. in order to raise land prices by planting landscape trees and installing a lux book on the 7,633m2, N Forest, 198m2, 754m2, which is owned by Jeju Special Self-Governing Province, and on the 7,633m2, N Forest, 198m2, 2,754m2, which is owned by the Defendant. Defendant B, in accordance with the above order, ordered the Jinc, an engineer, to remove miscellaneous trees in the above forest, and cut land into a lux area with a gradient, and filled up land into the 35m2,000m2, and to create 15m2,000,000,000.
