피고인은 2012. 8. 1. 23:50경 서울 중구 봉래동2가 122에 있는 서울역광장에서 술에 취하여 위 광장에서 종이박스를 깔고 잠을 자고 있던 노숙자인 피해자 B(65세)에게 "야 이 새끼야 네가 나이 먹으면 다냐 , 내가 하나님이다."라고 말하면서 발로 툭 차고, 일어나는 피해자의 머리를 주먹으로 3-4회 때려 폭행하였다.
