The plaintiff's claim against the defendants is dismissed in entirety.
Litigation costs shall be borne by the plaintiff.
Reasons
1. Facts of recognition;
A. On October 17, 2019, at around 09:00, the person under whose name the beneficiary sent a mobile phone text message to the Plaintiff, stating that “The horse will connect the Plaintiff with the inspection,” “I will pay KRW 1,200,000.”
B. After the locking, the person in charge of the name in question assumes a false inspection and calls the Plaintiff, which read, “The information on the account is leaked because the Handphone is infected with a virus, and all property, such as cash, stocks, real estate, etc., can be registered with the safety asset at the Financial Supervisory Service.”
C. Accordingly, the Plaintiff deposited shares-backed loans, real estate-backed loans, insurance cancellation fees, etc. to the E bank account under the Plaintiff’s name (F; hereinafter “Plaintiff account”) to the name-disscepted persons who misrepresented with the prosecutor in charge, etc., and sent the name, resident registration number, E bank account number, password number, and theOTP number to the name-disscepted persons.
On the other hand, at around 11:57 on October 8, 2019, Defendant B sent bank account numbers, physical cards, etc. in photographs to obtain loans by artificially creating transaction records from persons who misrepresented the employees of the management team of national happiness funds and raising credit points. As such, Defendant B said, at around 11:57, that the certified text messages should be sent in photographs, and that the certified text messages should be notified of the authentication number at the time of misunderstanding.
Accordingly, Defendant B believed the horses of the person who was not entitled to the name, sent his account number (H; hereinafter “Defendant B account”) and physical card to that person in a photograph and notified him of the certification number.
E. On October 16, 2019, Defendant C sent bank account numbers, physical cards, etc. in photographs and sent certified text messages to the lender’s employees by artificially raising credit points by artificially creating transaction records from his name-free persons who misrepresented the borrower’s employees at around 08:14 on October 16, 2019.
