Reasons
Punishment of the crime
1. On February 22, 2015, at around 01:35, the Defendant driven a B SP car while under the influence of alcohol content of about 0.209% in the section of about 2km from the end of the horse brea-dong in the Tran-dong, Western-gu, Chungcheongnam-gu to the front road of the folk village restaurant located in the Dong-gu, Chungcheongnam-gu, Dong-gu.
2. The Defendant is a person engaging in driving of BSP cars.
On February 22, 2015, at around 01:35, the Defendant driven the said car under the influence of alcohol, as set forth in paragraph (1), and driven it along three-lanes from the etrop to the etrop-distance distance.
Since a crosswalk is installed, there was a duty of care to prevent accidents in advance because there was a pedestrian who is driving a motor vehicle by checking well the right and the right of the road, and if there was a pedestrian who is driving the motor vehicle, he did not interfere with the crossing of the pedestrian.
Nevertheless, when the Defendant neglected to do so and neglected to do so, the Defendant got the victim E (the age of 36) who dried the crosswalk from the left side of the running direction of the Defendant, to the right side of the Defendant’s vehicle, as the front part of the Defendant’s car.
