1. All of the plaintiff's claims are dismissed.
2. The costs of lawsuit shall be borne by the Plaintiff.
Reasons
1. Details of ruling;
A. On December 11, 1998, the Plaintiff engaged in the business of collecting earth and rocks upon obtaining permission for collection of stone with a size of 16,427 square meters from the conversion market in order to operate a stone collection station in Seosung-si, Seosung-si, Seosung-si, Seosung-si, 998, after obtaining permission for collection of stone with a size of 16,427 square meters.
The plaintiff used the existing village access road and judged that it is necessary to establish a tinsan exclusive access road, and obtained the consent of the relevant land owners on April 2002, the plaintiff opened a tin mountain access road with the width of 8m wide from 306m wide from 130-1, e.g., e., s., e., e., s., e., g., e., g., e., g., g., s.
B. On December 3, 2008, the Defendants applied for approval of a plan for the creation of a grain marine industrial complex (hereinafter “instant project”) with respect to the 1,629,329 square meters in Seosung-si, Seosung-si, the Republic of Korea (hereinafter “the instant project”). On June 3, 2009, after obtaining approval of the plan in accordance with the above application through resident briefing sessions, the construction of a grain marine industrial complex was implemented. The instant land to enter into the instant project area, which was incorporated into the instant project area, was expropriated from the relevant land owners.
At the time of approval of the above plan, the Plaintiff was granted quarrying permission extended from May 8, 2009 to December 31, 2009 with respect to forest land (area 88,123 square meters, hereinafter “the instant stone collection site”) on the 16th and 16th and other mar (hereinafter “the instant stone collection site”).
C. Until December 31, 2009, the Plaintiff obtained permission to extend the period of permission to collect earth and stone for the existing permitted area by June 30, 201, and obtained permission to collect earth and stone for the purpose of taking out the quantity of extraction and collection after the permission to collect earth and stone until September 30, 201, and again for the same purpose.
