The grounds of appeal are examined.

1. On the grounds of appeal by the prosecutor, the lower court affirmed the first instance judgment that acquitted the prosecutor on the charge of attempted fraud and embezzlement, on the grounds stated in its reasoning.

Examining the reasoning in light of the record, the lower judgment did not err by exceeding the bounds of the principle of free evaluation of evidence against logical and empirical rules.

2. As to the Defendant’s appeal, the Defendant did not submit the appellate brief within the submission period, and did not state the grounds on the petition of appeal.

3. Therefore, all appeals are dismissed. It is so decided as per Disposition by the assent of all participating Justices on the bench.
