A defendant shall be punished by imprisonment for not less than two years and six months.

However, the execution of the above punishment shall be suspended for three years from the date this judgment becomes final and conclusive.

Punishment of the crime

On March 6, 2014, the Defendant got the victim D (one, half, and twenty years of age) who sought studio studio clat through “Stockholm clatus”, a smartphone operator, and got the victim into the office of the Defendant.

피고인은 2014. 3. 7. 11:00경 서울 동대문구 E 302호에 있는 피고인의 집에서, 바닥에서 자기로 했던 피고인이 침대 위 자신의 옆에 누워있는 사실을 잠에서 깨 알아챈 피해자가 일어나 “집으로 가겠다”고 하자, “한번만 안아 달라”고 말하며 피해자를 강제로 끌어안아 침대에 눕히고 피해자 위에 올라탄 다음, 강하게 저항하는 피해자의 얼굴 부위를 주먹으로 수회 때릴 것처럼 하여 피해자를 위협하고, 전날 피해자의 학생증을 확인하였음을 빌미로 피해자에게 “너 학교 아니깐 걸레라고 소문낸다”고 협박한 후 피해자의 옷을 강제로 벗긴 뒤 손가락을 피해자의 음부에 수회 넣고, 피고인의 성기를 피해자의 음부에 수회 삽입하여 피해자를 강간하고, 이로 인하여 피해자에게 치료일수를 알 수 없는 처녀막 손상 등의 상해를 입게 하였다.
