A defendant shall be punished by imprisonment for one year.
Reasons
Punishment of the crime
On October 22, 2013, the Defendant was sentenced to one year of imprisonment for fraud, etc. in the Suwon District Court’s Ansan Branch, and the execution of the sentence was terminated at the Sungsung Vocational Training Correctional Institution on August 29, 2014.
1. On August 23, 2010, the Defendant was sentenced to a fine of 300,000 won for larceny in the Suwon District Court’s Ansan Branch, which was sentenced to a suspended sentence of 8 months for larceny, etc. on January 7, 2011; on September 22, 2011, the Defendant was sentenced to a prison term of 10 months for night-time buildings intrusion and larceny, etc. in the Ansan District Court’s Ansan Branch; and on October 22, 2013, the Defendant was sentenced to imprisonment with prison labor for one year for larceny, etc. from the Suwon District Court’s Ansan Branch Branch.
At around 06:00 on January 14, 2015, the Defendant: (a) cut off one 2.50,000 won of the market price containing credit cards, etc. from the victim’s Handbag, which the victim was placed on the knickter by the victim D, which was operated by the victim D in Ansan-si, Sinsan-si; and (b) cut off the victim’s knicker from the victim’s Handbag.
2. On January 14, 2015, the Defendant calculated the drinking value of 2.9 million won in an entertainment tavern managed by the victim E, a member of Ansan-si, an Ansan-si, as indicated in paragraph (1), and acquired a pecuniary benefit of 2.90,00 won by having the victim pay the drinking value with the said card by suggesting that the credit card was the Defendant’s card was the Defendant’s card.
3. On January 14, 2015, the Defendant violated the Specialized Credit Financial Business Act: (a) around 06:56, the Defendant settled the drinking value of KRW 2.90,000,000, as described in paragraph (2), in an entertainment tavern managed by E in Ansan-si, a member of Ansan-si; (b) presented a credit card sales slip in the name of D that was stolen by the Defendant to E who is an employee, and used a stolen credit card by allowing E to prepare a credit card sales slip of KRW 2.9,00,000, and
