1. On December 20, 2018, the Defendant: (a) on each real estate listed in the attached list to the Plaintiff, the Suwon District Court Seosung registry office.
Reasons
1. Facts of recognition;
A. From April 2018, the Defendant supplied A Co., Ltd. (hereinafter referred to as “A”) with steel materials, and has maintained a continuous transaction relationship on the condition of cash settlement or bill settlement for the portion supplied at the same time.
B. The Defendant supplied A with steel of KRW 11,390,654 on April 30, 2018, and received KRW 11,390,654 on May 30, 2018, and supplied steel of KRW 32,323,517 on May 31, 2018, and received KRW 32,323,517 on June 29, 2018. The Defendant supplied steel of KRW 89,475,161 on June 30, 2018 and received KRW 89,475,161 on July 31, 2018, and supplied KRW 200 million on August 137, 2018, and received KRW 100 million on August 31, 2018.
(C) Around October 31, 2018, steel was supplied with steel products of KRW 184,523,229 on August 31, 2018, and KRW 37,205,915 on September 5, 2018 (the balance 184,523,229), and KRW 174,269,106 on September 30, 2018, and was supplied with steel products of KRW 179,935,774 on several occasions until October 31, 2018 (the balance 178,856,561 won), and supplied steel products of KRW 107,764,624 on October 31, 2018.
C. A supplied additional goods without paying KRW 178,856,56,561, which should have been paid by the end of October 2018, and paid the amount that should have been paid by the end of November 2018 was either KRW 286,621,185, or KRW 286,621,185. Accordingly, the Defendant demanded payment from the Defendant, but at the time, the financial situation was not sufficient at the time, and the E (hereinafter referred to as “E”) issued by the Company E (hereinafter referred to as “E”) as security, provided bills of KRW 285,00,000 at face value issued by the Company E (hereinafter referred to as “E”), and then paid the outstanding amount to the Defendant upon receiving subsequent payments from D.
However, A was unable to pay the outstanding amount to the Defendant by the end of November 2018, and the outstanding amount was transferred to the Defendant, but on December 20, 2018, the due date of the bill was 260,669,156.
