1. Facts of recognition;

A. The registration of ownership transfer was completed in the name of E E orchard 2,235 square meters in the land Jeju-si, and the registration of ownership transfer was completed in the name of F, which is the Plaintiff’s seated land, after the F’s death.

After that, on March 23, 1992, the registration of ownership transfer was completed due to the sale in the name of G, the Plaintiff’s Ratter.

The plaintiff purchased E land from G on February 12, 1998 and completed the registration of ownership transfer on February 13, 1998, which is the following day.

B. H land Jeju-si, I Forest land 779 square meters is land owned by J. A. B. A. around October 1972, the land was divided into 2,016 square meters of I Forest land, 288 square meters of K road, and 271 square meters of C orchard (hereinafter “1 land”).

On August 29, 1981, the registration of ownership preservation was completed in the name of L on August 29, 1981, and the registration of ownership transfer was completed in the name of M as the husband of the plaintiff on January 24, 1989.

On September 28, 1979, the registration of ownership preservation was completed in the name of North Jeju-gun, and on September 27, 1994, the registration of ownership transfer was completed in the name of the defendant for the first land.

C. At the time of the State of N land, D orchard 9,124 square meters (hereinafter referred to as “the second land”) and O forest 112 square meters are land owned by P. As to the second land, the registration of ownership transfer was completed in the name of the Defendant on June 17, 1985, and the registration of ownership transfer was completed in the name of M on February 14, 1994.

G and the Plaintiff’s occupied G are access to land E, and each occupation and use of part 39 square meters in the inside part of the attached drawing on the land owned by the Defendant (hereinafter “inboard part”) and part 180 square meters in the inside part of the land owned by the Defendant (hereinafter “inboard part”) and part 180 square meters in the inside part of the land owned by the Defendant. The Plaintiff succeeded to the possession of the inside part and the inside part while purchasing land E from G.
