1. Basic facts

A. The Plaintiff is a company that operates an Internet shopping mall under the name of “C” and engages in the wholesale and retail business for the importation of new events, clothing, and musical beverages, and the Defendant is a company that engages in software development and sales business.

B. On March 1, 2016, the Plaintiff concluded a contract for purchase and supply of software (hereinafter “instant contract”) with the Defendant during the period from March 1, 2016 to November 1, 2016, by setting the contract amount of KRW 495,00,000, and the term of the contract from March 1, 2016 to November 1, 2016.

The main contents of the instant contract are as follows.

4. Business consultation with project managers of Gap, and the process and schedule management of projects; and

5. A’s resolution of issues arising in the course of project alteration management and project implementation with Gap’s project manager.
