1. As to KRW 217,150,00 and KRW 500,00 among the Plaintiff, the Defendant shall pay to the Plaintiff KRW 16,50,00 from May 7, 2015, and KRW 16,50,00.
Reasons
1. Determination as to the cause of claim
A. 1) The Plaintiff is a legal entity established with the purpose of urban planning and district unit technology service business, etc. (2) On October 4, 2013, the Plaintiff entered into a service contract with the Defendant on the “establishment of permission to engage in development activities to create a driving range B in Yangju-si,” and determined service costs as KRW 326,150,000 (including value-added tax) and agreed to pay each of the remaining KRW 226,150,000 as the down payment at the time of concluding the contract, and within 15 days after approval for permission for development activities.
(3) On January 12, 2015, the Plaintiff (hereinafter “the first service contract”) concluded a service contract with the Defendant on March 3, 2015, pertaining to “authorization for implementation plan for access to a golf driving range at Yangju-si” and agreed to pay KRW 5,00,000 as the down payment at the time of concluding the contract, and KRW 15,00,000 as the remainder within three (3) days from the banking business day after the authorization of the implementation plan.
(2) On May 7, 2015, the Plaintiff received a decision on May 7, 2015 on the designation of an urban planning facility project operator and the authorization of an implementation plan for urban planning facility project operator and the implementation plan in the two weeks pursuant to the second service contract (hereinafter “the second service contract”).
B. According to the above facts, the defendant calculated 126,00,000 won (=the down payment of KRW 100,000,000 for the remainder of KRW 20,150,000 for the remainder of KRW 200,000 for the surveying cost of KRW 20,000 for the remainder of KRW 20,150,000 for the second service cost, and KRW 22,00,000 for the second service cost of KRW 20,000 for the second service cost of KRW 20,000 for the service cost of KRW 20,000 for the second service cost of KRW 10,00 for the value-added tax of KRW 20,000 for the service cost of KRW 20,000 for the second service cost of KRW 102,000 for the service cost of KRW 17,000 for the remainder of 17,000.
