A defendant shall be punished by imprisonment for a term of one year and four months.
The defendant shall complete the sexual assault treatment program for 40 hours.
Reasons
Punishment of the crime
The Defendant is a person who delivered alcoholic beverages from September 2019 to February 18, 202 to B, a supplier of alcoholic beverages, from September 2019.
1. On December 6, 2019, around 11:30 on December 6, 2019, the Defendant: (a) opened an entrance with a key received in advance from the victim for alcoholic beverage delivery; (b) invaded upon the victim’s inside the entrance; and (c) stolen cash 50,000 won.
In addition, the Defendant, from that time to December 10, 2019, intruded the above structure at least three times, such as the list of crimes in attached Form 1, and stolen cash and precious metals worth KRW 3,360,000, total amount of money owned by the victim.
2. At around 10:59 on January 31, 2020, the Defendant: (a) opened an entrance from the above Eppp on a prior key; and (b) invaded upon the entrance, but did not find stolen objects.
Thus, the defendant did not commit an attempted crime, even though he attempted to steal the property owned by the victim by impairing the structure.
3. On February 18, 2020, the Defendant: (a) around 03:00 on February 18, 2020, at the “H” restaurant operated by the victim G in Jung-gu Incheon Metropolitan City, Jung-gu; (b) opened an entrance with a password prior to being known for alcoholic beverage delivery from the victim; and (c) intruded the victim into the entrance and stolen it with a cash of KRW 50,00 in a small credit cooperative.
In addition, from February 21, 2020 to February 04:00, the Defendant invadedd a structure on four occasions at night, such as the attached Table 2, and stolen it with a total amount of KRW 780,000,000,000 from time to time.
4. On February 21, 2020, the Defendant, who attempted to larceny at night buildings, opened an entrance with a password prior to being known, around 03:12, at the “K” restaurant operated by the victim J of the victim in Michuhol-gu Incheon, Michuhol-gu.
